  • An eviction notice is a document that informs a tenant they must leave or be removed from the place they occupy. If the situation between tenant and landlord improves (back rent is paid up in full, for example), the notice can be retracted, but that is rarely the case once it gets to the point of an eviction notice being posted.

  • Eviction usually takes 5-10 weeks, although it could be faster or much slower (over a year) depending on the conditions. For example, when government implements a moratorium on evictions, you can’t remove tenants until it expires; in the case of a pandemic or other natural disasters, the process will also take longer.

  • To evict a tenant without going to court, you first need to send them an eviction notice within a “reasonable” timeframe, usually one payment period (e.g. 1 month if the tenant pays monthly and no other lease is in place). If done legally and after the proper waiting period, you are allowed to change the locks even with their possessions still inside.
