("Property") to [Tenant.FirstName][Tenant.LastName] ("Tenant") according to the terms of this Georgia Lease Agreement.

Term of Agreement

The term of this rental lease begins on (Start.Date) ("Start Date") and is valid on a lease basis for one calendar year or until (End.Date) ("End Date"). Should the Tenant stay on Property after the End Date, it will operate using a month-to-month basis until the parties renew or cancel the contract.

Upon this contract's termination, the Tenant must vacate the premises unless the Landlord renews the residential lease agreement or knowingly accepts Rent on a month-to-month basis contract.

Rent

The Tenant understands they must pay a monthly rental amount to lease the Property and agrees to pay $(Rent.Amount) ("Rent") by the 1st of each month. Should the Landlord not receive the payment by the 1st of each month, a late fee is levied on the Tenant, according to the late fee section below.

Should the Start Date not be on the 1st, the Landlord shall prorate the Rent payment remitted on the 1st based on 30 days.

Approved payment methods the Tenant can use are (Payment.Method1) or (Payment.Method2), with the registered payment address being [Landlord.StreetAddress][Landlord.City][Landlord.State][Landlord.Company]. It's the Tenant's responsibility to deliver the Rent to the Landlord on or before the 1st of the month, whether it's made online or mailed.

Security Deposit

Upon execution of this agreement, the Tenant is required to make a refundable security deposit of $(Deposit.Amount). The Landlord must keep the security deposit in a federally regulated depository or an escrow account and will inform the Tenant in writing of the account's location.

The Tenant is entitled to a written list of existing damage to the Property before paying the security deposit and advance notice of any deductions.

Within 30 days of when the parties terminate the lease and the Tenant vacates the Property, the Landlord must refund the security deposit and provide an itemized list showing all deductions to the Tenant.

The Landlord is entitled to make deductions on the security deposit under the following circumstances:

  • Having to clean or repair the premises beyond the average wear and tear.

  • As repayment on any unpaid Tenant fees.

  • Any other charges according to the contract's terms.

The Tenant acknowledges that they can't treat the security deposit as payment of any Rent payment.

Late Fees and Returned Checks Charges

The Landlord will charge a late fee of $(Late.Fee) per day if the Tenant's payment isn't received by the 5th of each month. Any returned checks or other payments returned for funds, a "stop payment" or any other reason will incur a one-time charge of $(Charge.Amount).

Occupants

The Landlord approves the following individuals staying at the Property while the Tenant rents it. The Tenant agrees that any individual not listed in the table below will remain at the premises for longer than fourteen (14) days without the prior written consent of the Landlord.

Maintenance and Upkeep

The Tenant must sufficiently maintain the inside and outside of the Property and notify the Landlord of any damages, problems, or malfunctions in writing. Should the Tenant's negligence or their guests cause the damages, the Tenant must bear the costs of fixing it.

The Landlord is responsible for mechanical damages, like HVAC breakages, plumbing, etc. The Tenant isn't permitted to modify the Property, such as nails in the walls, painting it, or other modifications that affect it.

Additional Provisions

Both parties must adhere to the below terms.

Rights of Access

The Landlord or Landlord's agents must give (Days) days written notice to the Tenant to enter the Property for previously agreed upon repairs and inspections. However, the Landlord can enter the premises without prior notice in the case of an emergency.

Assignment and Subletting

The Tenant cannot assign or sublet this lease agreement to any other party without the Landlord's prior written consent. However, the Landlord can hand over this contract to a new Property Owner should they sell it during the lease's term.

Quiet Enjoyment

The Tenant must respect the Property's neighbors and community and not cause excessive noise or nuisances. Commission of criminal conduct on the premises will be grounds for the contract's immediate termination.

Utilities

Both parties agree to be responsible for utilities as per the below terms:

Keys

All keys to the Property are part of the Landlord's ownership, and the Tenant can't make any copies thereof. Should the keys be lost, the Tenant will arrange with the Landlord for new ones at the Tenant's cost. At the termination of this lease, the Tenant will return all keys to the Landlord.

Other Provisions

Rights of Termination

This agreement terminates on (End.Date) by 11:59 pm. The Tenant must vacate the premises immediately upon its termination. If the Tenant doesn't leave the premises, the lease converts to a month-to-month contract, and all terms of this Georgia residential lease agreement remain in full force and effect.

Any failure to comply with the contract's terms or if the Tenant misrepresents any material fact on their rental application is immediate grounds for termination of this contract. However, the Landlord must give appropriate notice to the Tenant and follow the procedures required by the laws of Georgia.

Move-in Payments Due

The following payments are due upon signing the lease before the End of Business on (Start.Date) and before the Tenant moves into the Property:

  • Security Deposit Returns: The Landlord will provide advance notice of all security deposit deductions. A move-out letter will contain any requirements and inspections the Landlord will complete during and after the Tenant vacates the premises.

  • Non-repayment of Rent: If the Tenant fails to repay Rent twice within twelve (12) months, the Landlord can immediately file for eviction.

  • Abandoned Property: If the Landlord believes the Tenant abandoned the Property and can't contact them, the Landlord can file for an eviction lawsuit after the Rent is overdue. When the court gives back the Property, the Landlord can dispose of all belongings left on the premises.

Agreement

This agreement is interpreted and governed by the laws of Georgia. Any contract dispute venue will be in the county of (County) in Georgia. Should a disagreement over this contract arise, both parties will make good-faith efforts to discuss the dispute in person and attempt to resolve it.

The entire agreement between the parties constitutes this document and all its attachments, if any. It supersedes all previous negotiations, commitments, and agreements, whether oral or written, concerning this tenancy.

Both parties must add all modifications to this contract in writing, and then each party must sign it. Both parties understand and agree to all the terms in this contract and the rights it grants as expressly set forth herein.
