Videographer Contract Template

This VIDEOGRAPHER CONTRACT (hereinafter referred to as the “CONTRACT”) made and entered into this _____ day of _____________, 20___, by and between: Name: [Client.FirstName][Client.LastName]  Name: [Sender.FirstName][Sender.LastName][Sender.Company]​

(Client company/name) (hereinafter referred to as "Client"); and (Videographer company/name) (hereinafter referred to as “Videographer”).

Description of Services

CLIENT agrees to hire the VIDEOGRAPHER to provide videography services for the project/s ("Event") described below.

TOTAL: $(insert amount)

Final footage

The final product will be delivered within (insert amount) days of the Event as a (list format of the file to be provided, e.g., HD video file, raw file, etc.), suitable for viewing on a computer.

Payment

The Client accepts to pay (insert number, eg: 25%, 40%, 50%) % of the amount of the total fee at the time of booking in order to secure the date of the Event, and the (insert remaining number)% shall be due on or before the date of the Event. 

Subsequently, the Client agrees to make all payments within (insert number, eg: 7, 15, 30) days of receipt of each invoiced amount.

All late payments shall incur a finance charge of (insert number) % of the total fee per month.

Responsibilities

Videographer:

Videographer is responsible for capturing all the Event's key moments on video, including setting up equipment, recording footage, and editing the final product. 

Key moments will include, but are not limited to:

(insert the key moments; e.g., in the case of a wedding event key moments would be the processional, exchange of vows, the first dance, father-daughter dance, mother-son dance, cutting of the cake, bouquet and garter tosses, any speeches made during the event, etc.)

Additionally, the Videographer must also be able to coordinate with other members of the Event to ensure that the Event runs smoothly.

Client:

Cooperation from the Client will be necessary in order to minimize expenses. Client shall be responsible for providing a list of specific shots or footage to be captured. 

The Client shall give the Videographer access to a power outlet, the information or materials that may be reasonably required in order to carry out the services, and permission to move freely about the Event space. 

Furthermore, the Client will be responsible for any and all expenses incurred in connection with this project, including but not limited to travel, lodging, and meals.

Reschedule

The Client shall inform the Videographer in writing as soon as possible of any desired changes to the schedule. If the Client requests a change to the schedule less than (insert number, e.g., 72 hours or 3 days) hours/days before the original Event start time, the Client agrees to pay the Videographer an additional $(insert amount) fee. 

Schedule changes requested more than (insert number, e.g., 72 hours or 3 days) hours/days before the Event are free of charge.

Videographer will make a good-faith effort to accommodate rescheduling requests whenever possible.

Cancellation

If the Client cancels the engagement for any reason, the Videographer shall be reimbursed for all reasonable out-of-pocket expenses incurred up to the time of cancellation plus a cancellation fee in the amount of (insert amount, e.g., 50%) of the agreed-upon total fee.

If the Videographer is unable to attend the Event for any reason whatsoever, the Client shall be refunded in full any deposits made and the Videographer shall make a reasonable effort to find a replacement.

Indemnification

The Videographer agrees to indemnify and hold the Client harmless from and against any and all claims, costs, losses, damages, liabilities, and expenses (including reasonable attorneys' fees and costs) arising out of or in connection with any claims or suits based on allegations that the use of any of the Videographer's materials infringes the copyright, trademark, trade secret or other intellectual property rights of a third party.

Videographer Safety and Security

The Client agrees to provide the Videographer with a safe and secure work environment. The Client further agrees not to hold the Videographer liable for any damages or injuries that may occur at the Event location.

Intellectual property

The Videographer will retain ownership of any and all video and audio recordings made in connection with this project. The Client will be granted a non-exclusive, perpetual, worldwide license to use the recordings for any lawful purpose.

Governing Laws

This contract shall be governed by and construed in accordance with the laws of the State of (insert state).
