  • An eviction notice should be used when a tenant violates the terms of the lease agreement or fails to fulfill their obligations as outlined in New York landlord-tenant laws. Common reasons for serving an eviction notice include non-payment of rent, unauthorized subletting, illegal activities, or breaching lease terms.

  • An eviction notice in New York doesn’t need to be filed until the notice period it provides for has expired and there’s still no compliance by the tenant(s). At this point, the written notice may be filed at court as part of a Petition for a Holdover Summary Proceeding. It’s advisable to approach an attorney to assist with these proceedings, as court rules, relevant laws, and procedures must be strictly adhered to.

  • For ordinary notices to evict for non-payment of rent, the tenant must be given a minimum of 14 (fourteen days) notice to cure the rental breach. If the lease is being terminated because of a breach of any of its provisions, a minimum of thirty notice must be provided. The same applies if there’s no fixed lease period or the tenant is on a month-to-month occupancy. Different notice periods will apply to a Petition for a Holdover Summary Proceeding.
