FAQ

  • To acknowledge a document means to declare it as authentic and given willingly. It is done by a signee of the aforementioned document in the presence of a notary. However, placing the signature can be done elsewhere, and the presence of a notary is not required for it.

  • A notarial Acknowledgment in the USA is a confirmation of authenticity of a signature on a document made in presence of a notary. Acknowledgment requires the signee to be personally present (unless online notarization is used), prove their identity, and state that they placed their signature willingly.

  • “Acknowledged” means recognized as true (e.g. acknowledging a child). “Accepted” can be used as a synonym, or it can mean being fine with something as it is. Legally, “acknowledgment” is stating the authenticity of a document to a notary.

  • Now, a document that is going to be notarized, has to have a notary section. If it does not and gets notarized, then it would be considered incomplete. So learn whether you need a special notarial section in advance, before starting to write the document.

  • “Notarized” means confirmed authentic by a notary. A person has to personally show up to the meeting with a notary (or to a virtual meeting, in the case of remote notarization), present a document to confirm their identity, and state that they signed the document in question of their own free will.

  • A remote online notarization (RON) is a process where a licensed notary notarizes a document via electronic means: e-signature, ID verification, electronic recordkeeping, etc. It is a very convenient recent alternative to a “classic” notarization and is as just as legal.

  • You can’t notarize a document without a notary. However, you might not have to personally visit them to do so. With remote online notarization (RON), you can notarize certain documents through various digital means. Check with your attorney whether your specific document can be notarized remotely.

  • An acknowledgment form is a document that is used to confirm something. For example, certain companies use order acknowledgment forms to confirm an order. They are legally binding provide an extra measure of legal protection in case of a dispute.

  • A notarized document might or might not be accepted at court. This depends on whether it is legally binding. For example, a contract needs to contain valid consideration (an adequate promise in exchange for something), be signed willingly by capable parties, and have a legal purpose.
